This has already been addressed by HPS, suggest you download patch 1.03b, from the HPS site -

Gentlemen: I am in a maneuver game playing as the Yank, HPS Shiloh - (They Met)... This matter three times today. I can up to three different gun batteries at was unmanned. When I went in to capture the guns, doing a melee they fired at me. How can that be? They are unmanned / uncrewed. I lost 20 men on one attack, the other unit got disrupted and the other I was able to take the guns. Has any one had that to happen to them? Is that a design error !!!
